1. Scope

This Privacy Notice explains how the data controller deSter BV, a company with registered office at Gelmelstraat 96, 2320 Hoogstraten, Belgium, telephone: +32 3 340 12 90, e-mail: dpo@gategroup.com(hereinafter “we” “us” “our(s)”), processes personal data when data subjects (hereinafter “you” or “your(s)”) use our website deSter | Creating Sustainable Food & Travel Experiences (hereinafter the “Website”).  

In this Privacy Notice we explain what personal data we process about you, for what purpose and on what legal basis. This Privacy Notice also explains your rights as a data subject.

In processing personal data we adhere to the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”) as well as any current or future national or international laws or regulations in execution or replacement thereof, including the Belgian act of 30 July 2018 on the protection of personal data with regard to the processing of personal data (hereinafter together referred to as “Applicable Data Protection Law”).

Notions such as “data controller” or “personal data”, shall have the meaning assigned to them under Applicable Data Protection law.

2. Overview of the personal data we process, purpose and legal ground

(a) Affiliates
deSter BV is a gategroup member. gategroup international group of companies (www.gategroup.com) where certain services are centralized by one or more affiliates for the entire group or a part of it. We therefore may share personal data with our direct and indirect affiliates for all purposes described above in the section 2. Whenever we share personal data with affiliates, we request from them that they commit themselves to process personal data in line with this Privacy Notice 

(b) Service providers
In addition, it may be necessary to share personal data with third parties who provide services to us for all purposes described above in the section 2. Such service providers may include:

  • advertising and media consultants;
  • market research consultants;
  • providers of technical services;
  • website designers and developers;
  • cloud computing service providers;
  • electronic storage providers;
  • customer services;
    recruitment agencies.

(c) Government agencies, such as law enforcement authorities.
In addition, we may always share personal data with third parties to the extent required or permitted by law. We may, by way of example, forward personal data to criminal prosecution authorities if necessary to investigate into illegal behaviour, or we may use personal data in court or debt collection proceedings if necessary to enforce our rights.

(d) Google Analytics
We may share information with Google through the tool Google Analytics. In order to find out more
about Google Analytics and what you can do if you do not agree that we forward information to Google

4. International transfers

Some of the recipients of personal data (see section 3) are located outside of the European Economic Area (“EEA”). As a result, the level of protection of your personal data may not be equivalent to that provided in the EEA. Before we make personal data available in such jurisdictions we do, however, make sure that such transfers are in compliance with Applicable Data Protection Laws. Unless the European Commission and the Belgian Data Protection Authority (in Dutch: ‘Gegevensbeschermingsautoriteit’, in French: ‘L’Autorité de protection des données’) have decided that the country of the recipient provides adequate data protection legislation, we commit to implementing an applicable transfer mechanism and required supplementary measures so as to ensure the adequate protection of your personal data.

5. Retention

In general we store personal data collected through the Website only insofar and as long as required to meet the purposes defined within this Privacy Notice or to the extent required by law.

The specific retention periods may vary depending on the processing activity at hand. Some relevant criteria we apply to determine retention periods are:

  • The duration of the service we provide;
  • Our legitimate interest(s) pursued;
  • Your consent to retain your personal data;
  • The application of legal obligations or limitation periods.

As soon as we no longer need your personal data and are no longer legally required to retain them, we permanently delete them or, if this is not possible, we anonymise them in our system.

In accordance with and subject to the conditions set out in Applicable Data Protection law, you may exercise the following rights:

  • The right to access: the right to request information about our processing of personal data. You may also request access to and obtain a copy of any personal data we have processed about you.
  • The right to rectification: the right to request that we rectify or complete incorrect/inaccurate personal data about you.
  • The right to erasure: the right to request that we delete your personal data
  • The right to data portability: the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit those data to another controller where technically feasible.
  • The right to restriction: You have the right to request that the processing of your personal data be limited in certain circumstances, meaning your data may only be stored and not further processed except in specific cases defined by law.
  • The right to object: the right to object to the processing of your personal data on grounds relating to your particular situation.
  • The right not to be subject to automated individual decision making producing legal or similarly significant effects: Should this change, we will update this notice accordingly.
  • Right to restriction: You have the right to request that the processing of your personal data be limited in certain circumstances, meaning your data may only be stored and not further processed except in specific cases defined by law.
  • The right to withdraw your consent: you have the right to withdraw your consent at any time. Withdrawing your consent does however not impact the lawfulness of processing based on your consent prior to its withdrawal.
